In most states you are required by law to carry workers comp insurance, regardless of your industry or number of empl oyees, says Somers. You may even be required to carry this coverage even if youre a sole proprietor.While very small businesses, or firms whose employees primarily work desk jobs, may skip coverage, assuming that accidents are unlikely, doing so could result in legal penalties and fines. It could also mean that an accident or injury at the workplace coulddrain your budget and involve you in a lawsuit. While these requirements are often similar, there may be crucial differences in the coverage your business is required to have, such as when you are required to buy coverage.Your states regulations also impact how and when you need to report ac cidents and the penalties for not doing so. In Florida, for example, employers are required to report claims within seven days after they are notified that an accident or injury occurred.If an employers late reporting of a claim delays the payment of an injured workers benefits, the state of Florida can penalize the business, explains Karen Phillips, the general counsel of the Florida United Businesses Associations workers compensation insurance program.If your employees work in more than one state, youll need to purchase coverage in each state, which can further complicate the requirements. Each state has an agency set up to manage their individual workers compensation programs, says Kevin Hess, a partner in management-side labor and employment law firm Fisher Phillips. Those agencies generally have a wealth of information available to employers to assist them in ensuring they are compliant with the necessary workers compensation requirements.What coverage you needMany factors impa ct the coverage your business needs, including the number of employees you have, their risk exposure and your businesss history of workplace accidents. Businesses in high-risk industries, such as construction, typically pay higher premiums and need more coverage than businesses where employees work at an office.Depending on your states requirements, business owners and sole proprietors may not need to purchase coverage for themselves. While that strategy may save you money right now, it could put you at risk in the long term.Small business owners need to understand the cost-benefit analysis, Phillips says. The owners health insurance policy may not cover workplace accidents, meaning the owner could have to pay out of pocket for any medical bills or lost wages they may have.Reporting a claimAny and all workplace injuries should be reported to your insurer as quickly as possible, even if they seem minor or if the employee doesnt press the matter.Often, what seems like a minor injury, like a bee sting, can turn into something much more extensive, like an infection, depending on the overall health of the injured worker, says Phillips.Its important to timely report all claims to the insurance carrier so they can get involved.Once you report a claim, the process is handled by the insurance company, allowing you to focus on running your business.The insurance company adjuster manages the injured workers care, and the insurance company hires an attorney to defend the employer should the injured worker hire an attorney, Phillips explains. The employers job during the claims process is to provide any information the claims adjuster asks for and to cooperate fully with any investigation. Employers who dont cooperate with the insurance company will often find their insurance being canceled.Post-accident investigation and drug testingCooperating with your insurance company often involves some degree of investigation. Larger businesses usually have detailed procedures or co rporate policies for how these investigations happen. SMBs should have these policies too.First and foremost, those policies should include documenting the injury, including any potential witnesses and when the claim was first reported. This should be done for each and every claim, advises Hess. The employer should also train employees on the appropriate steps to investigate and document a workplace injury.In some cases, you may want or need to administer a drug test following a workplace accident. States have different rules for when and how these tests can be used, and in many cases, this depends on how clearly your companys drug-testing policies are outlined and available to employees.Employers should maintain drug-testing policies that are compliant with applicable laws, including the limitation on post-accident drug testing, Hess says.To make sure your drug-testing policies pass legal muster, consult with a lawyer before you put them in place, long before any workplace accident occurs.What isnt covered by workers compWhile workers compensation insurance covers your business in many scenarios, it doesnt protect you in all of them.Workers comp doesnt cover all lawsuits over employee work injuriesit only covers what the state requires them to cover, Somers warns. In some states, certain schrifts of workplace injuries and illnesses, along with accusations of negligence from employees, may not be eligible for the benefits included in workers comp.To protect against lawsuits in these instances, you may need additional coverage, such as employers liability insurance. My heart sank (and I felt like throwing up).And then there was that time I created a brilliant training program that gave new hires thenegotiation skillsthey needed to blow their quotas off the charts which the client declined and stuck with their current training plan that wasnt working. My heart sank (and I felt like throwing up).Oh, and what about every time someone misses a meeting with you, reschedules three times in a row, has a coworker take credit for an idea that was yours, a client that decides to go in a different direction, or your manager declines to recommend you for the manager training program? All rejections to get over (without throwing up). And thats just focusing on work-specific rejection of course, there are all kinds of other rejectio n to be dealt with as well in life, as well, including from friends, romantic relationships, and family members or parental rejection.Why were wired to feel shame biologicallyIts easy to bedefeatedby rejection. Our biology works against us. I work with many women (and men, were all menschenfreundlich) who let the fear of rejection hold them back. They stop speaking up in meetings, sharing ideas, get quiet, put their head down and just do their job, all because of the shame they feel when they get a no, and they fear they feel in pessimistically anticipating that no (a self-fulfilling prophecy, if you will).This shame is rooted in our biology. Like so many of our annoying biological responses that worked well to keep us alive when we lived in caves but do notlagehing to grow our relationships or careers now, we have to consciously work to change it.Back then, our survival was dependent on belonging to a tribe. We are biologically programmed to belong to enaya our survival.When we fe el a social rejection, we feel it deeply and it lasts for a long time. I bet you can remember a social or peer rejection much more acutely than physical pain. Science backs this up.Why were wired to feel shame emotionallyWhen you recall rejection, you feel the SAME pain as you did the first time. Not so much with physical pain. Sure, you remember that time you broke your arm and you remember that it really hurt, but the acute physical pain usually doesnt reoccur when you run through it in your mind.Not so for the emotional pain we feel with rejection.Studiesshow that human beings brains react in the same way to physical and emotional pain. When you rewind the tape in your mind and watch it over and over again, that moment when you shared your great idea that was rejected by your boss, you feel the same physical responses your stomach gets tight, you sweat, your heart beats faster, or you feel like throwing up. This ability to re-watch that pain over and over (and over and over, for some of us) was the way our biology helped us survive. By making it sting so much worse than a physical injury, the mere thought of rejection ensured we followed the status quo to avoid it in the future.Three steps to get over rejection and try again1) What you thinkAsk yourself is this about me?Usually, its not about you. Your inner critic may start to blame you, but dont allow it to be the loudest voice in the room. Think about what youd say to a friend in the same situation. Would you say, Oh, youre such a stupid idiot, why did you say that? You look so dumb now, everybody knows your ideas are the worst No, you would never say that to a friend. Why would you say it to yourself? Dont. You deserve as much (if not more) respect as your friends. Youre a human being, too, after all.If it IS about you, its time to get curious. After you go cry in a dark room alone, dry those eyes and find out why.Look that rejection in the face, acknowledge it and dismiss it.Say to yourself, Hey, tha t sucked. I feel this shame and embarrassment and I am not going to be beaten by it. We all have great ideas and bad ideas and great ideas with bad timing. We all do a great job one day and totally mess up the next. Its part of being human.Dont let it define you or dopermanent damageto your self-esteem. Dont let it shut you down or quiet your ideas, the good ones or the bad ones. Because you never know when a bad idea will suddenly turn into a great one and change the world.2) What you sayWhy did the other person say no? What is the rejection all about?Without a reason, we tend to spiral into self-doubt, thinking it was just a bad idea. But more often than not, it has nothing to do with you or your idea. Its often the timing, things that you dont know about or cant see from your position.Asking questions to find out more aboutwhyyou got a no is the key to successfully negotiating a yes for the next time, or even changing a no into a yes when you find out more. Often as you ask quest ions, you start to see that you can adjust things in your proposal.Questions like Id like to understand more so that I can shape my proposal for the next time. Can I ask you a few questions to be sure I understand? Asking if you can ask questions might at first seem redundant, but it has an important purpose. If you jump right into asking questions, those questions can be perceived as defensive, as I need to know all the reasons why you think my idea wont work because Im hurt, versus your real intent, which is, Id really like to understand more about how you see this so I can solve the problem in a way that works. Help me understand more about what you liked and didnt like. Asking a question with help me understand is a way to diffuse your defensiveness. It also draws other people in to be helpful. You want to come across as being genuinely curious.3) What you doKeep asking, keep proposing, keep sharing and keep challenging the status quo. You cannot stop. Your action item is to not let a no to stop you.
